1. Acceptance of Terms

By accessing and using cmhort.com (the “Site”) and purchasing products from CMHort (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Site or services.

2. Commercial Use and Eligibility

Our products, including vertical grow racks and integrated cultivation systems, are designed for commercial and industrial use only. By purchasing from us, you represent that you are a business entity or a professional cultivator and that you are of legal age in your jurisdiction.

3. Legal Compliance (Cannabis Industry)

CMHort provides agricultural equipment. We do not sell or distribute cannabis. It is the sole responsibility of the Buyer to ensure that their use of our equipment complies with all local, state, provincial, and federal laws and regulations. CMHort is not responsible for any legal repercussions arising from the Buyer’s cultivation activities.

4. Orders, Quotes, and Payment

  • Quotes: Price quotes are valid for [30] days unless otherwise stated.
  • Accuracy: We reserve the right to correct any errors in pricing or descriptions and to cancel orders if information is inaccurate.
  • Payment: Orders are processed once payment is confirmed via our authorized payment gateways. For large-scale installations, custom payment schedules may apply as per individual contracts.

5. Shipping and Freight

  • Logistics: Because of the size and weight of vertical racking systems, equipment is typically shipped via LTL (Less Than Truckload) or dedicated freight.
  • Delivery: Risk of loss passes to the Buyer upon delivery to the carrier. The Buyer is responsible for inspecting all shipments for damage before signing the Bill of Lading.
  • Surcharges: Any additional fees (liftgate, residential delivery, redelivery) incurred will be the responsibility of the Buyer.

6. Professional Installation

While our racks are designed for ease of use, CMHort highly recommends professional installation for multi-tier systems. We are not liable for system failures, structural collapses, or injuries resulting from improper assembly or exceeding weight capacities.

7. Limitation of Liability

To the maximum extent permitted by law, CMHort shall not be liable for any:

  • Crop Loss: Any failure of equipment that leads to plant loss or damage.
  • Business Interruption: Loss of revenue or profits due to delays or equipment downtime.
  • Indirect Damages: Any incidental or consequential damages arising from the use of our products.

8. Intellectual Property

All content on this Site, including product designs, technical specifications, CAD drawings, and branding, is the exclusive property of CMHort. Unauthorized reproduction is strictly prohibited.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois without regard to its conflict of law principles.
